The United States Supreme Court mandated since l973 that every community define the adult community standard against obscenity. Because of this legal directive, every citizen should participate in the meaning of obscenity, therein addressing various arenas in their community. Since pornography is destroying the family and is behind every sex crime, the definition of obscenity should not be limited necessarily to the police or prosecutors, but again, developed by registered voters who will consider the safety, health, and morality of their community, thereby creating public policy. Eventually, the community standard for obscenity is further determined by the jury on any given civil or criminal court case involving obscenity. When a community is committed to morality and decency standards, family foundations are strengthened by the framer's intent from the United States Constitution.

According to news sources, on Monday China launched a crackdown on Internet pornography, targeting online portals and search engines such as Google. According to a statement issued by NPR, “The crackdown focused on pornography but is part of a larger Chinese effort to control freedom of expression…”

China is to be commended for cracking down on Internet pornography. As the U.S. Supreme Court put it in a 1973 obscenity case, Miller v. California, 413 U.S. 15, 34-35:
“[T]o equate the free and robust exchange of ideas and political debate with commercial exploitation of obscene material demeans the grand conception of the First Amendment and its high purposes in the historic struggle for freedom. NEW CHARGES A federal judge charged in Houston with fondling a court employee and trying to force her into a sexual act pleaded innocent Wednesday to new allegations brought by another former employee. U.S. District Judge Samuel Kent entered his plea a day after a federal grand jury added three new charges to the indictment it issued in August that accuses him of making unwanted sexual advances toward his former court case manager. The new charges _ aggravated sexual abuse, abusive sexual contact and obstruction of justice _ allege Kent tried to force a second female court employee into a sexual act and lied about it to investigators. "The charges are not true," Dick DeGuerin, Kent's attorney, said after the hearing, adding he was limited in what he could say because of a gag order in the case. Prosecutors declined to comment. Kent, the first federal judge charged with sex crimes, said very little during Wednesday's hearing, in stark contrast to his first arraignment in September when he was very vocal and vowed to bring a "horde of witnesses" in his defense. Edward Prado, a 5th U.S. Circuit Court of Appeals judge brought to Houston to preside over the arraignment, ordered that Kent remain free on his own recognizance. UNTHANKFUL A New York doctor who gave his wife a kidney is suing her for $1.5 million — or the return of the vital organ — after he says she cheated on him with a physical therapist. Richard Batista, 49, is demanding the sum in the middle of a messy divorce with his now-estranged wife, who suffered kidney ailments for years before the transplant. The Long Island surgeon said he gave the gift of life to his wife in 2001, but things turned sour just two years later while she was recovering from a karate injury, the New York Post reported. His wife, 44-year-old Dawnell Batista, had an affair with her physical therapist in 2003, he said. She recovered from the knee injury, but he says her low blow has him all out of joint. "I saved her life and then to be betrayed like this is unfathomable. It's incomprehensible," he told the Post. "She engaged in an extramarital affair and refused to go to marital counseling and reconciliation." Two years after the affair began she filed for divorce, and Batista accuses her of trying to limit his access to their three children, ages 8, 11 and 14. "She slapped me with divorce papers in the operating room while I was trying to save another patient's life," he told the Post. |
